By creating a CallWerx account or using CallWerx to handle calls on your organization's behalf, you agree to these Terms of Service. If you're accepting on behalf of a business, you're confirming you have the authority to do so.
CallWerx provides software that answers and routes phone calls, uses AI to capture caller information, and hands that information to your staff as a pre-filled message for dispatch. Availability of specific features depends on your plan and configuration.
You're responsible for the accuracy of information you provide when setting up CallWerx, for keeping your login credentials secure, and for the actions taken by staff accounts you create. Notify us promptly if you suspect unauthorized access to your account.
You agree not to use CallWerx to:
If you enable text-message dispatch notifications, you're responsible for only adding staff phone numbers you have authorization to text on behalf of your business. Message frequency varies with call volume. Message and data rates may apply. Any staff member can opt out of further messages at any time by replying STOP, or by asking their account administrator to remove their number. Carriers are not liable for delayed or undelivered messages.
CallWerx is billed on a monthly, per-seat subscription basis. Additional features and modules (such as invoicing/billing tools or training modules) may be added as optional, separately-priced add-ons, and usage-based charges may apply where noted in your order form or account agreement. Fees are billed in advance unless otherwise agreed in writing, and are non-refundable except as required by law or as CallWerx otherwise agrees.
CallWerx retains all rights to the software itself. You retain all rights to the call and message data your account generates. We don't claim ownership of your content, and we use it only to operate the service for you.
CallWerx is provided "as is." While we work to keep the service reliable, we don't guarantee it will be uninterrupted, error-free, or that AI-captured call details will always be perfectly accurate — your staff should review dispatched messages before relying on them for anything urgent or safety-related.
To the maximum extent permitted by law, CallWerx is not liable for indirect, incidental, or consequential damages arising from use of the service, including missed or misrouted calls. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.
You may cancel your account at any time. We may suspend or terminate accounts that violate these terms, misuse the service, or fail to pay applicable fees, with notice where practical.
These terms are governed by the laws of Arizona, without regard to conflict-of-law principles.
We'll update the date at the top of this page when these terms change, and will make reasonable efforts to notify active Customers of material changes.
